Find a Endodontics Expert →Overview
An endodontics expert decides whether root canal care met the standard for a reasonably careful dentist: whether the tooth needed the treatment, whether the right tooth was treated, whether the procedure was done properly, and whether a complication was recognized and managed. This page covers root canal therapy and related surgery. Broader dental practice belongs to a general dentistry expert, jaw and major nerve surgery to an oral and maxillofacial surgeon, and an infection that spreads beyond the mouth to an infectious disease or emergency physician.
The expert reads the chart, the radiographs in native digital form, any cone beam scans, anesthesia notes, consent forms, referral letters, the treating endodontist's notes and the later repair records. Dental images are often the best evidence. They show the length of the fill, the position of a broken file and any material pushed past the root tip.
The most useful published picture is a study of 97 United States endodontic lawsuits from 2000 to 2021. Its authors found that 84 of the defendants, or 86.6 percent, were general practitioners 1. Of the 97 cases, 42 favored the plaintiff, 53 favored the defendant, one was a partial result and one settled 1. Those are reported legal cases, not a survey of all claims, so the numbers show patterns and not risk rates.
The allegations were specific. Improper instrumentation or obturation was the largest group among procedural claims, followed by failure of informed consent, infections, broken instruments, improper diagnosis and injury to anatomy 1. Dentists were found liable in all the cases alleging paresthesia and failure to use a rubber dam, though the rubber dam group was only 2 cases 1. Plaintiffs prevailed in 5 of 6 root perforation allegations and in 5 of 6 wrong tooth allegations 1.
FDA says dental cone-beam images provide three-dimensional information rather than the two-dimensional information of a conventional X-ray, and that these exams typically deliver more radiation than conventional dental X-rays 2. Whether a scan was needed depends on the tooth and the anatomy.
The rubber dam isolates the tooth, keeps the field clean and protects the airway from files and irrigants. Its absence is hard to defend. Sterilization problems raise a different kind of claim. CDC reports that breakdowns in dental infection prevention have included failure to heat sterilize handpieces between patients and failure to monitor autoclaves 3. An exposed patient can bring a claim on those facts alone, depending on the forum's law.
Materials can matter as well. FDA regulates root canal filling resin as a device intended for use during endodontic therapy to fill the root canal 4, so a product claim is possible but rare. The expert should identify what was actually used.
Consent was among the most common allegations in the study 1. A patient should hear about the risks that matter for this tooth, the alternatives including extraction, and the expected result. The form alone does not settle it. A rushed talk on an emergency visit may leave little in the chart, and state law decides what had to be said.
Match the expert to the defendant. A general dentist doing root canals may be judged by a general dentist with substantial endodontic experience, or by a specialist, depending on state law. Look for a licensed dentist with advanced endodontic training, active clinical practice at the time of the events and board certification where held. Nerve injury treatment and prognosis may need an oral and maxillofacial surgeon or a neurologist.

Not by itself. A separated instrument is a recognized risk. The case usually turns on whether it was recognized, disclosed and managed, and on whether infection or harm followed a late referral.

The rubber dam isolates the tooth and protects the airway, and its absence is hard to defend. In the published study, dentists were liable in the small group of cases alleging failure to use one. The standard in a given case is a matter for expert testimony.
Irrigant forced past the root tip can injure tissue. The expert reads the technique, the working length and the images, then looks at how fast the problem was recognized and treated.
In general, endodontics expert fees are determined by the expert themselves, based on a variety of criteria. Among those criteria are experience, the number of images, the volume of records, the type of injury and the amount of testimony. Vident does have some influence over expert fees by comparing experts within a specialty, but ultimately it is a personal decision by the expert.
