Find a Cruise Ship Medicine Expert →Overview
A cruise ship medicine expert decides whether a passenger or crew member got the care a ship's medical center should have given, given what it carried, who staffed it and how far it was from shore. Time and distance shape every opinion. The ship is a small hospital without a blood bank, a CT scanner or a surgeon, so the core questions are recognition, stabilization and the decision to get the patient off. This page covers shipboard care. Ship handling belongs to a master mariner, maritime law practice to a maritime and admiralty expert, and an injury's mechanics on deck to a slip and fall or biomechanical expert.
The expert reads the ship's medical log, nursing notes, vital signs, medication records, telemedicine calls, deck logs, evacuation requests and shore hospital records. Those records belong to the cruise line, so they should be demanded and preserved quickly.
For years, the Barbetta rule shielded shipowners. The Eleventh Circuit described it as immunizing a shipowner from respondeat superior liability whenever a ship's employees render negligent medical care to passengers 1. Franza v. Royal Caribbean changed that in the circuit that covers Florida. An elderly passenger fell at port in Bermuda, hit his head and was wheeled back to the ship's medical center, where he allegedly received negligent care 1. The court held that both actual and apparent agency theories were available, saying it could discern no sound reason in law to carve out a special exemption for all acts of onboard medical negligence 1. It noted that modern cruise ships house thousands of people 1.
Apparent agency still needs facts. A Florida federal court, in a decision before Franza, said that a cruise line's statement that a doctor will be provided does not by itself establish apparent agency, and that a plaintiff must show additional affirmative acts to hold the doctor out as the line's agent 2. There the plaintiff pointed to the doctor's title and uniform 2. Ticket contract terms and forum clauses can also limit a case, and the time to sue is usually short, so counsel should read the ticket first.
Most cases come down to a few decisions. Was the head injury, chest pain or abdominal pain recognized? Did the patient have the workup the onboard equipment allowed? Should the doctor have called for a medical evacuation or diverted to port? Older passengers on blood thinners, as in many fall cases, need particular care after a head strike, and a ship without a CT has few options except getting them ashore.
The standard is not that of a large hospital. It also is not a free pass, because the cruise line chooses the equipment, staffing and itinerary. An expert compares care with what the ship's own protocols required and with what a competent shipboard physician would do. Claims can also involve hiring: did the doctor have the emergency training the job demanded?
Federal law sets specific medical duties. Under the Cruise Vessel Security and Safety Act, a vessel owner must maintain adequate, in-date supplies of anti-retroviral medications and other medications to prevent sexually transmitted diseases after a sexual assault, and equipment and materials for a medical examination 3. The Act calls for medical staff able to promptly perform an examination and to provide proper treatment 3. It also requires a log book of certain complaints and sets design standards, such as ship rails not less than 42 inches above the cabin deck 3. The Department of Transportation publishes cruise line incident reports 4, which can help show what was happening on a line or ship.
CDC says traveling on cruise ships can create the risk for illness from contaminated food or water or, more commonly, through person-to-person contact, and its Vessel Sanitation Program helps the industry prevent and control public health issues 5. It also publishes ship inspection scores 5. An outbreak case looks at the ship's sanitation records, its response to the first cases and how it isolated the sick.
Look for an emergency physician with direct shipboard experience, ideally as a senior physician or medical director for a cruise line. Emergency medicine training is usually expected for this work. Experience in remote or expedition settings helps. Ask how the expert has handled evacuation decisions and whether the opinion accounts for the ship's actual equipment and position. A maritime expert can address the ship's side of a diversion.
In Franza v. Royal Caribbean, the Eleventh Circuit could discern no sound reason in law to carve out a special exemption for all acts of onboard medical negligence.

In general, cruise ship medicine expert fees are determined by the expert themselves, based on a variety of criteria. Among those criteria are experience, the length of the voyage record, shipboard and shore records, evacuation issues and the amount of testimony. Vident does have some influence over expert fees by comparing experts within a specialty, but ultimately it is a personal decision by the expert.
