About Industrial Engineering Expert Witnesses

An industrial engineering expert decides whether a production system or work method was designed and run the way a competent operation would, and whether it could have delivered what someone claims it could. The questions are practical. Was this job built to put a worker at risk? Could this line hit the contract rate? Was the defect a one-off or the product of an unstable process? This page covers manufacturing systems and work methods. Whether a machine's design was defective belongs to a mechanical or design engineer, how a person perceives and responds belongs to a human factors expert, and hazard analysis across a site belongs to a safety engineer.

The expert reads work instructions, standard times, production and scrap records, maintenance logs, quality records, training files and often the floor itself. Video of the actual job is often worth more than the written procedure, since the fight is usually about the gap between the two.

Work Methods and Worker Injury

In a plant injury, the expert asks how the job was designed to be done and how it was really done. The federal rules set a floor. One or more methods of machine guarding must protect the operator and other employees from hazards such as point of operation, ingoing nip points and rotating parts 1. For servicing and maintenance, the employer must establish a program of energy control procedures, employee training and periodic inspections 2, and must inspect each procedure at least annually 2. Production pressure often enters here: a method that clears jams with the machine running may be how the line kept its rate.

Manual handling is measured differently. Employers owe a workplace free from recognized hazards likely to cause death or serious physical harm 3, and the usual engineering tool is the revised NIOSH lifting equation. Its recommended weight limit is a load nearly all healthy workers could handle over a substantial period without an increased risk of lifting-related low back pain, and its lifting index is a measure of relative physical stress used to identify hazardous tasks 4.

Those numbers have limits an expert should state plainly. The authors wrote that the equation had not been fully validated 4. A later one-year study of 78 industrial workers linked a composite lifting index above 2 with self-reported low back pain, and its authors called for larger samples 5. The index shows that a job design carried risk. It does not by itself show that this job injured this worker, which is a medical question.

Capacity, Throughput and Process Capability

Commercial cases ask what a system could produce: whether a supplier could meet a rate, whether a line met a contracted performance level, or what output a plant would have reached without a breach. An expert rebuilds capacity from cycle times, changeovers, downtime and yield, then compares that with what the records show. A nameplate rate is a starting point, since a system runs at the pace of its constraint.

Quality claims use a defined measure. Process capability compares the output of an in-control process to specification limits, forming a ratio of the specification width to the process width, measured as 6 process standard deviation units 6. The words in-control matter. A capability number from an unstable process says little, so the expert checks the data for stability before relying on any index. That same analysis helps separate a stray defect from a process that was never able to meet the specification.

Medical Device Manufacturing Changed in 2026

Device cases need the current rule. The Quality Management System Regulation became effective on February 2, 2026, amending the device good manufacturing practice requirements of 21 CFR Part 820 and incorporating ISO 13485 by reference 7. Manufacturers must now document a quality management system that complies with the applicable requirements of ISO 13485 and other requirements of the part 8. An opinion on a device built before that date reads the prior Quality System Regulation, and an opinion on later production reads the new text. Facts spanning the change may need both.

Who Is Qualified

Look for an engineer who has run or redesigned real production systems in a comparable industry, with records of time studies, layouts or process improvement work. NCEES offers a PE Industrial and Systems exam, though many industrial engineers practice without a license, so ask directly. Match the witness: an ergonomist or human factors expert for perception and fit, a safety engineer for site hazard programs, a forensic accountant or economist for the dollars that follow from a capacity opinion.

Process capability compares an in-control process to its specification limits, so a capability number from an unstable process says little.

Frequently Asked Questions

What qualifications should an industrial engineering expert witness have?

Look for hands-on experience running or redesigning production systems in a comparable industry, along with work measurement and statistical quality experience. Licensure varies in this field. NCEES offers a PE Industrial and Systems exam, but many industrial engineers practice without a license, so ask about it directly and weigh the practical record.

How is an industrial engineer different from a safety engineer?

An industrial engineer looks at how the work and the system were designed: methods, pace, layout, capacity and quality. A safety engineer looks at hazard identification and control programs across a site. In a plant injury the two can overlap, so the opinion should stay with the question each witness has actually worked on.

Does the NIOSH lifting equation prove a job caused an injury?

No. It is a job design tool. The recommended weight limit and lifting index show relative physical stress and help identify hazardous tasks. The authors said the equation had not been fully validated. Whether a particular job injured a particular worker is a medical causation question.

What is process capability and why does it matter in a dispute?

Process capability compares the output of an in-control process to its specification limits. It helps show whether a process could meet a specification at all, or whether a defect was a stray event. The analysis depends on a stable process, so the data should be checked for stability first.

Which quality rule applies to medical device manufacturing?

It depends on the date. The Quality Management System Regulation became effective on February 2, 2026 and incorporates ISO 13485 by reference. Earlier production falls under the prior Quality System Regulation text. An opinion should name the version in force when the device was made.

How much does an industrial engineering expert witness cost?

In general, industrial engineering expert fees are determined by the expert themselves, based on a variety of criteria. Among those criteria are years of plant experience, licensure, testimony history and the scope of site work. Vident does have some influence over expert fees by comparing experts within a specialty, but ultimately it is a personal decision by the expert.
