Find a Investment Management & Fiduciary Standards Expert →Overview
An investment management and fiduciary expert decides which standard governed the person who gave the advice or chose the investment, and whether the process behind that decision met it. The answer usually starts with the role. A broker, a registered investment adviser and a retirement plan fiduciary answer to three different standards, and the date of the conduct can change the standard again. This page covers conduct and process. Securities fraud, market manipulation and disclosure cases sit with a securities expert, and valuing a business is separate work.
A broker-dealer making a recommendation to a retail customer must act in that customer's best interest at the time of the recommendation, without placing its own financial interest ahead of the customer's 1. Regulation Best Interest breaks that into four parts: disclosure, care, conflict of interest and compliance 1. The SEC set a compliance date of June 30, 2020 and said the rule enhances the standard beyond existing suitability obligations, including by expressly requiring consideration of cost 2. Conduct before that date is generally read against the older suitability standard, so the expert must place each recommendation on the timeline.
The care obligation sets out what the file should show: an understanding of the risks, rewards and costs of the product, and a reasonable basis to believe the recommendation is in this customer's best interest given the customer's investment profile 1. That profile includes age, other investments, financial situation, tax status, objectives, experience, time horizon, liquidity needs and risk tolerance 1. The SEC also said it does not believe the rule creates any new private right of action 2, so the expert should work from the claims actually pleaded.
An adviser's duty comes from the Advisers Act as the SEC read it in its 2019 interpretation: a duty of care and a duty of loyalty, together an overarching obligation to act in the client's best interest 3. The adviser and client may shape the relationship by agreement, with full and fair disclosure and informed consent 3. So the advisory agreement and the adviser's disclosures come first. For retail clients, the SEC says high risk products such as penny stocks or thinly traded securities generally call for heightened scrutiny of fit with the client's risk tolerance and objectives 3. For institutions, the mandate shapes the inquiry 3.
ERISA asks whether the fiduciary acted with care, skill, prudence and diligence, and the Supreme Court said in Hughes v. Northwestern (2022) that the inquiry is context specific and includes a continuing duty to monitor investments and remove imprudent ones 4. Courts must also give due regard to the range of reasonable judgments a fiduciary may make 4.
Three 2026 developments matter for any report written now:
The expert reads committee minutes, investment policy statements, consultant reports, fee disclosures and the comparator funds themselves.
Match the expert to the seat. A broker conduct case calls for someone who supervised retail recommendations at a broker-dealer. An adviser case calls for portfolio management and compliance experience at a registered adviser. A plan case calls for someone who served on or advised investment committees. The CFA charter requires passing three exams and 4,000 hours of relevant work experience 8, and it is a strong signal of investment knowledge, but it does not by itself show supervisory or plan experience. A forensic economist or damages expert may compute the loss, and a securities expert addresses fraud and disclosure questions. The fiduciary expert addresses conduct, not the legal conclusion that a duty was breached.
Regulation Best Interest requires a broker-dealer making a recommendation to a retail customer to act in the customer's best interest at the time of the recommendation, without placing its own financial interest ahead of the customer's.

FAQ
Match the expert to the role in the case: a former broker-dealer supervisor for a broker case, an adviser compliance or portfolio manager for an adviser case, and an investment committee member or consultant for a plan case. The CFA charter requires three exams and 4,000 hours of relevant work, and it is a strong signal of knowledge, but it does not replace direct experience with the conduct at issue.
Regulation Best Interest applies to recommendations to retail customers and had a compliance date of June 30, 2020. The SEC said it enhances the standard beyond existing suitability obligations by adding disclosure, conflict of interest and compliance obligations and by expressly requiring consideration of cost. The date of each recommendation decides which standard to read.
It depends on what the person did and the law pleaded. Regulation Best Interest sets a best interest standard for broker-dealers making retail recommendations, while investment advisers owe a fiduciary duty under the SEC's reading of the Advisers Act. State law may add duties in some settings, so the expert should work from the forum's law and the facts of the relationship.
After Texas federal courts vacated the 2024 Retirement Security Rule, the Labor Department published a March 20, 2026 notice restoring the five-part test for investment advice fiduciaries. In March 2026 it also proposed a process-based safe harbor for selecting designated investment alternatives. The Supreme Court heard argument in Anderson v. Intel in October 2026 on meaningful benchmark pleading.
Not by itself. The Labor Department describes the duty of prudence as focused on process at the time of the decision, and the Supreme Court has said courts must give due regard to the range of reasonable judgments a fiduciary may make. Performance can still be evidence, particularly of a failure to monitor and remove an imprudent investment.
In general, investment management expert fees are determined by the expert themselves, based on a variety of criteria. Among those criteria are professional experience, forensic experience, industry certifications, regulatory knowledge, and publications. Vident does have some influence over expert fees by comparing experts within a specialty, but ultimately it is a personal decision by the expert.
