About Banking & Trust Expert Witnesses

A banking and trust expert decides whether a bank or trust department acted as a prudent institution of its type would have, measured against the specific rule, internal procedure and industry practice that applied that day. The usual questions are how a payment got through, what the bank saw in an account, how a loan was underwritten and how a fiduciary account was reviewed. This page covers bank operations, compliance, lending and trust administration. A forensic accountant traces the money, and a securities or investment expert addresses portfolio advice to retail clients.

Payments: Wires, Checks and Allocation of Loss

Business email compromise and wire fraud cases often turn on the security procedure. Under UCC 4A-202, a payment order that the bank verified can be effective as the customer's order, even if unauthorized, when the security procedure is commercially reasonable and the bank accepted the order in good faith and in compliance with the procedure 1. Commercial reasonableness is a question of law, decided by considering the customer's wishes, the circumstances known to the bank including the size, type and frequency of normal orders, alternatives offered, and procedures in general use by similarly situated customers and banks 1. So the expert does not announce the legal answer. The expert supplies the facts the court weighs: what was offered, what the customer chose, and what comparable banks used.

Check fraud has its own timetable. UCC 4-406 requires a customer to exercise reasonable promptness in examining a statement, and a customer who does not discover and report an unauthorized signature or alteration within one year after the statement is made available is precluded from asserting it 2. Within that frame, comparative fault is often the fight, which brings in the bank's own handling of the items and the customer's internal controls. State enactments can differ, so the forum's version controls.

Fraud Through an Account: What the Bank Saw

In Ponzi and embezzlement cases, plaintiffs ask what the bank knew from its monitoring. The expert reads account opening files, customer risk ratings, transaction patterns and the policies in force. Two constraints shape that work.

  • Suspicious activity reports are off limits. A bank must report suspicious transactions of $5,000 or more in the circumstances the rule describes, and a SAR and any information that would reveal its existence are confidential 3. An expert cannot assume whether one was filed, and a report should not be written to imply it
  • The standard for knowledge comes from the claim. Whether monitoring gaps amount to knowledge of a fraud is decided under the law of the claim pleaded, which is why a compliance opinion needs to stay on what the program required and what was done

The compliance baseline moved in 2026. On February 13, FinCEN granted relief from identifying and verifying beneficial owners at each new account opening: a covered institution may limit that step to when the legal entity first opens an account, to later points when it has knowledge of facts that call the information into question, and as needed under its risk-based procedures 4. In April, FinCEN proposed a rewrite of anti-money laundering program rules around risk-based programs 5. That is a proposal, so its status must be checked, and conduct is measured by the rule in force on the date of the conduct.

Lending and Trust Administration

For residential mortgage loans, Regulation Z bars a creditor from making a covered loan without a reasonable and good faith determination, at or before consummation, that the consumer will have a reasonable ability to repay 6. The expert reads the loan file, income and asset verification, the underwriting guidelines in force and the exceptions log. Commercial loan disputes run the same way against the bank's own credit policy and approval record, along with the loan documents.

For national banks, 12 CFR 9.6 sets a sequence. The bank reviews a prospective fiduciary account before accepting it, makes a prompt review of all assets on acceptance where it has investment discretion, and reviews those assets at least once every calendar year 7. The trust instrument and state trust law supply the duties themselves. Common claims involve concentration in a single holding, failure to diversify, unsuitable real estate or business interests, and conflicts with the bank's own products. The committee minutes and annual review files usually decide how the record reads.

Who Is Qualified

No license covers bank officers as such, so the career record is the credential: senior roles in operations, compliance, credit or trust, ideally at a bank of similar size and charter, or time as a federal or state bank examiner. The American Bankers Association offers the Certified Regulatory Compliance Manager, Certified Trust and Fiduciary Advisor, and Certified AML and Fraud Professional 8. Match the expert to the function. A credit officer should not give the wire room opinion, and a compliance officer should not give the trust opinion.

Under UCC 4-406, a customer who does not discover and report an unauthorized signature or alteration within one year after the statement is made available is precluded from asserting it against the bank.

Frequently Asked Questions

What qualifications should a banking expert witness have?

Look for direct, senior experience in the function at issue: wire operations, compliance, credit or trust. Prior work as a bank examiner helps. The American Bankers Association offers the Certified Regulatory Compliance Manager and the Certified Trust and Fiduciary Advisor. Experience at a bank of similar size and charter usually matters more than title.

Who bears the loss on a fraudulent wire?

Under UCC 4A-202, a verified payment order can bind the customer even if unauthorized, when the security procedure is commercially reasonable and the bank accepted the order in good faith and in compliance with the procedure. Commercial reasonableness is a question of law. Other sections and the deposit agreement may also apply, and state enactments can differ.

Can an expert review suspicious activity reports?

Generally no. A SAR and any information that would reveal its existence are confidential under 31 CFR 1020.320, subject to the limited disclosures that rule allows. Expert work has to be built on the account records and program documents, and counsel should plan the report around that limit.

What changed for bank customer due diligence in 2026?

On February 13, 2026, FinCEN issued an order letting covered institutions limit beneficial owner identification and verification to when a legal entity first opens an account, to later points when facts call the information into question, and as needed under risk-based procedures. In April 2026 FinCEN also proposed new program rules. The rule in force on the date of the conduct controls.

How often must a trust department review accounts?

For national banks, 12 CFR 9.6 requires a review before accepting a fiduciary account, a prompt review of all assets on acceptance where the bank has investment discretion, and an asset review at least once during every calendar year. State-chartered institutions look to their own regulators and state law.

How much does a banking expert witness cost?

In general, banking expert fees are determined by the expert themselves, based on a variety of criteria. Among those criteria are professional experience, forensic experience, industry certifications, regulatory knowledge, and publications. Vident does have some influence over expert fees by comparing experts within a specialty, but ultimately it is a personal decision by the expert.
